TRAINING AND TESTING

  1. Training and testing at Surepass Rider Training is subject to the terms and conditions herein and in any publicity material or correspondence as issued by Surepass Rider Training.
  2. All students booking and completing a motorcycle course at Surepass (with the exception of the free trial lesson) must hold a UK driving licence, provisional or full, with valid provisional motorcycle entitlement (Category A - Motorcycle and/or Category P - Moped).  It is the student's responsibility to ensure they hold the correct licence and subsequent categories.
  3. On each day of training all Surepass students will be required to provide and show all necessary documents to the Surepass Instructor.  Required documents are:
  • ü Driving Licence - showing current residential address. Both parts required if photo card licence held or valid passport if not the new photo style licence.
  • ü CBT certificate - must be valid (if completing full licence course)
  • ü Motorcycle Theory certificate - must be valid (if completing full licence course)
  • ü Proof of insurance (if using students own vehicle)
  • ü Valid MOT certificate (if required)
  • ü V5 (owners logbook) or letter from registered owner allowing use of vehicle for training (user must have valid insurance for vehicle) 

FAILURE TO PRODUCE DOCUMENTS 

  1. If the student fails to produce any of the required documents for a CBT course then training cannot commence.  No refund can be issued.   The student is also liable for any outstanding balance. 
  2. If a student commencing a full licence course does not produce his/her documents on the first day they will be able to return at mid-day, with correct documents and rejoin the course.  If the student's course is a guaranteed pass course the student loses the guaranteed pass as half a days training has been lost.  No refund will be given for the half a day lost.
  3. Any student failing to produce the required documentation to the DSA examiner on his/her practical test will have the test terminated by the DSA and the test fee shall be lost.  If the student is on a guaranteed pass course, the failure to produce the required documentation invalidates the guarantee. 

GUARANTEED PASS COURSES 

  1. From 1st January 2009 Surepass is no long able to offer guaranteed pass courses.  This is due to the introduction of the new motorcycle test in 2009 by the Driving Standards Agency.  Under the current proposals for the new motorcycle test it will no long be possible to implement a guaranteed pass course. 

  2. INJURIES AND ACCIDENTS 
  1. The student understands that motorcycle training can occasionally be hazardous and agrees to undergo any training at their own free will.
  2. The student accepts responsibility for their own actions during the training and any possible injury caused to them during their motorcycle training.
  3. The student understands that there are no "dual controls" on motorcycles and therefore accidents that occur are the sole responsibility of that student.  Surepass is not liable for any injury sustained.
  4. Any student that sustains injury during their training will have the training stopped.  Surepass recommends in all cases that injuries are checked at the local hospital.  Surepass is happy to transport the student to the hospital.  If the student is happy to continue the training it will be at their own discretion. 
  5. Any student that sustains an injury that prevents them from continuing the training will forfeit the remainder of the course and any subsequent fee or/and test.  Continuation or replacement training is at the discretion of Surepass. 
  6. Surepass reserves the right to terminate training in the event of any student riding in a dangerous or negligent manner whilst on a public highway.  Any student seen miss-using Surepass vehicles or equipment will have his/her training terminated.  No refund will be issued. 
  7. Any student that crashes/damages a Surepass vehicle that results in damage to the vehicle (substantial or otherwise), rendering the vehicle un-useable, will have the days training terminated and any subsequent test fees lost.  No refund will be given for the days training.   Any future training will be chargeable and at normal rates and any guaranteed pass will be invalidated.

BOOKINGS 

  1. For all Full Licence, including Refresher and Advanced, training courses a booking deposit of £100 applies.  This is in addition to the required practical test fee (if applicable).  Upon commencement of all training courses, the additional balance must be paid on the first day of training.
  2. Payment can be made to Surepass by either Debit/Credit card or cash.  Surepass does not accept cheques.
  3. Surepass reserves the right to cancel, amend or re-arrange the date and time of training (giving reasonable notice where possible) and without unreasonable delay. 

COURSES (PACKAGES)

  1. Students opting for a Surepass Training Package understand that a package price is usually discounted from the normal daily rate for training.
  2. The full cost of the course must be paid for on day one of the course, minus any deposits already paid.
  3. The entire course must be booked in it's entirety to obtain the package course rate - otherwise the normal daily rate applies.
  4. Usual booking and cancellation terms apply to a package course.
  5. Once a package course has commenced no refund can be issued for training days/test fee not used.
  6. All package courses must be completed within 6 months from the first date of the course.  Training days and/or test fees may not be carried over past the 6 month period without prior written consent from the Surepass Chief Instructor.  Without written consent all training days and/or test fee, past the 6 month period and not yet utilised will be forfeited. 

DSA PRACTICAL MOTORCYCLE TESTS

  1. Both A2 (Restricted) and Direct Access licenses are gained through a two-part practical test (Part One and Part Two.)  It is a requirement of the DSA that Part One is passed before Part Two is attempted. 
  2. If Part One is failed, three clear working days are required before a further Part One attempt. 
  3. If Part Two is failed, ten clear working days are required before a further Part Two attempt. 
  4. If a Part One and Part Two have been booked by the student and both tests are close together and, the student then fails Part One leaving the student unable to take Part Two, the student is not automatically entitled to cancel his/her training (and subsequent Part Two) at Surepass if the Surepass (and DSA) cancellation requirements have not been met.
  5.  If the student requires further training for a re-test of either Part One or Part Two usual training fees apply.  Please see Cancellations for conditions applying to this situation.  Surepass is unable to alter or affect the Terms and Conditions of the DSA.

CANCELLATIONS

•1.         CBT course cancellations and charges:
CBT courses must be cancelled with no less than 3 clear working days (72 hours) notice, (working days do not include weekends, public or bank holidays).  CBT's cancelled with 3 days (minimum) notice will incur a £5 administration charge. Cancellations must be made during office hours, Monday-Friday (9am - 5.30pm). Cancellations made after working hours are deemed to have been made the following day.
Students cancelling CBT courses within the 3 days notice period are liable for the full cost of the course. If the CBT course can be re-sold within that period, (and all reasonable efforts will be made by Surepass to re-sell the course), the student will only incur a £5 administration charge.

•2.        Practical Motorcycle Test (DSA) cancellations and charges:
Practical tests booked at Surepass must be cancelled with no less than 10 clear working days notice (working days do not include weekends, public or bank holidays). Students cancelling practical tests with 10 clear working days notice, (minimum), will incur a £5 administration charge.  Cancellations must be made during office hours, Monday-Friday (9am - 5.30pm). Cancellations made after working hours are deemed to have been made the following day.
Students cancelling practical tests at Surepass within the 10 clear working day notice period will be liable for the full test fee. If a further test is required by the student an additional test fee is applicable. Test fees are set by the DSA - not Surepass.

•3.        Full Licence, Refresher and Advanced Course cancellations and charges:
Full licence courses (including Refresher and Advanced courses) booked at Surepass must be cancelled with no less than 10 clear working days notice (working days do not include weekends, public or bank holidays). A £5 administration fee will be charged (and the the practical test fee if applicable) by students cancelling full licence training with 10 working days notice (minimum). Cancellations must be made during office hours, Monday-Friday (9am - 5.30pm). Cancellations made after working hours are deemed to have been made the following day.
Students cancelling full licence courses (including Refresher and Advanced) within the 10 clear working day cancellation period will be liable for the full cost of the course. If the cancelled course can be re-sold within that period, (and all reasonable efforts will be made by Surepass to re-sell the course), the student will incur only a minimum administration fee of £20.00.

•4.       Free trial assessment cancellation and charges:
The student can cancel the trial assessment at any time without incurring any charges.

Non attendance by the student at the booked date and time will be deemed a cancellation and if the required notice has not been received the full course fee will have become immediately payable and due.  If payment is not received from the absent student on the day of the booked course a letter will be sent to the student requesting payment.  For this letter an administration charge of £20 will be added to the cost of the course.  Any subsequent letters to the student will be billed at £10 per letter.   

FREE ASSESSMENTS & FIRST GO LESSONS 

  1. Surepass does not charge for free assessments or first go lessons.  However, the student is wholly responsible for any damage caused to Surepass vehicles and property and/or third party damage unless the Insurance Waiver has been paid.
  2. If the Insurance Waiver has not been paid any damage caused to Surepass vehicles/property will result in the student being invoiced for damages.  This payment is to be made to Surepass within 7 days.   

DAMAGE WAIVER

  1. All Surepass students are covered by the Surepass Fully Comprehensive Insurance Policy. 
  2. Like all Insurance Policies Surepass has an excess to pay in the event of a claim. 
  3. Many training schools will insist that the student has to pay the excess on the Insurance in the event of an accident.  Surepass believes their students should be better protected and have the option to "opt out" of paying this Insurance excess.
  4. For this reason we have the "SUREPASS DAMAGE WAIVER". 
  5. For a small one-off payment you are protected during your training against accidents and accidental damage to both Surepass vehicles/property and Third Party vehicles/property. 
  6. Excess waiver fees range from £10 to £40 maximum.
  7. The excess waiver fee must be paid on the first day of training.  On courses spanning more than one day the excess waver is a one-off fee and NOT a daily fee.
  8. Please note that should you decline the Damage Waiver, in the event of an accident/damage you will be liable for any costs incurred up to the value of £500.
  9. If you accept the Damage Waiver, in the event of an accident/damage you will NOT be liable for any costs incurred, except in cases of deliberate/wilful neglect or abuse. 
  10. Loss of keys, by students, to vehicles is not covered under the Damage Waiver.
  11. Any repair and/or damage rectification to Surepass vehicles will be completed at Surepass Mechanical Services or any other establishment as determined by Surepass.
  12. Surepass reserve the right to charge labour fees on any repair/damage rectification work in the event that the student has declined the Damage Waiver and then subsequently damages Surepass vehicles.
  13. Quotes for damage to Surepass vehicles must be paid for by the customer/student within 7 days of receiving the quote.  Any delay of payment will result in immediate legal action.  Surepass reserves the right to claim for loss of earnings if the vehicle is rendered off road, damages and/or any related legal costs.
  14. Parts ordered for damaged vehicles must be order by Surepass from authorised and known suppliers only.  Surepass will not accept parts ordered by the customer/student from unknown sources.

VEHICLES

  1. Any student using his/her own motorcycle for training must ensure that the vehicle complies with all legal requirements in existence at the time of training and/or testing. 
  2. Vehicle road tax must be valid and displayed, L plates must be displayed front and rear, and vehicle tyres must be within the legal limits. 
  3. The maintenance and reliability of the student's vehicle shall be the student's sole responsibility. 
  4. Students turning up for training on un-roadworthy vehicles have the option to upgrade, for an additional fee, to a Surepass vehicle or cancel the training. 
  5. No refund will be given for a cancelled course and the full cost of the course cancelled will have become immediately payable and due.   

MEDICAL CONDITIONS

  1. Full disclosure must be made by the student, at the time of booking, if he/she knows of any drug/medical/medication condition (by prescription or otherwise) that could impair his/her riding ability.  Failure to disclose any issues that become apparent to Surepass Instructors will result in the termination of the training.  No refund will be issued. 

SUREPASS VEHICLES 

  1. Students using Surepass vehicles are responsible for the vehicle they are using on the day.  Students that have taken out the Insurance Waiver are covered in the event of an accident except in cases of damage caused due to reckless behaviour, neglect or miss-use.  The student will then be invoiced for any costs and payment must be forthcoming within 7 days. 
  2. The vehicle keys are the responsibility of the student using the vehicle.  Any key that is lost or damaged by the student will result in the student being invoiced for a completely new lock set for the vehicle.  The Insurance Waiver does not cover lost/damaged keys.
  3. Surepass will endeavour to match students with suitable vehicles for all motorcycle courses but in the event that Surepass is unable to do so, for reasons beyond their control, a substitute vehicle will be made available.
  4. Surepass vehicles are all thoroughly maintained and serviced.  However, in the event of a mechanical breakdown Surepass will endeavour to provide a substitute vehicle.  Surepass is not responsible for any mechanical breakdown of its vehicles.
  5. Students are NOT permitted to sit on, touch or ride any Surepass vehicle without the direct permission of a Surepass Instructor.  Students are only permitted to use a Surepass vehicle in the presence of an Instructor.  Students sitting on, touching or riding a vehicle without the Instructor being present are using the vehicle without Surepass permission.  In this instance all training will be terminated immediately.  No refund is offered. 

SAFETY EQUIPMENT

  1. Surepass will provide necessary safety equipment, free of charge, for those students that require it.  All safety equipment is regularly checked to ensure it meets required health and safety requirements.  Students that require safety equipment will look after all equipment provided and return each item used at the end of each training day.  
  2. In the event that any equipment is damaged, either by deliberate act or accident, the student will reimburse Surepass the cost to replace the damaged item, unless the Insurance Waiver has been taken out.  The Insurance Waiver only covers accidental damage.   
  3. Surepass has sufficient motorcycle safety helmets in a variety of sizes to suit most head sizes.  Should a student not find a safety helmet at Surepass to fit, then the student will have to provide his/her own safety helmet.  If the student is attending a training course and discovers that Surepass safety equipment is not suitable (for size reasons), the student will be unable to commence the days training for safety reasons.  No refund can be given for the training day/s booked.  Surepass offers free, trial lessons so students can ensure all Surepass safety equipment is suitable for their needs prior to training.

HEIGHT RESTRICTIONS 

  1. Surepass does not have any height restrictions for any of its motorcycle courses.  However, if a student turns up for training and is unable to safely control any class of motorcycle then Surepass reserves the right to determine a safer option.  If a students course is cancelled due to height issues then there is no refund or replacement course offered.  Surepass does however offer a free trial lesson prior to booking a course to prevent any such situation occurring. 

EYE SIGHT TEST

  1. On the first day of training you will be expected to read a number plate from the legally required distance of 20.5m.  Failure to clearly read the number plate will result in the immediate termination of your training.  No refunds will be issued.

ALCOHOL

  1.  Any student arriving for his/her training who appears under the influence of alcohol will be asked to complete a Surepass Alcohol Breathalyzer Test.  Failure to either comply or pass the breathalyzer test will result in the immediate cancellation of the entire training day. No refund will be given for the days training lost and any guaranteed pass will be invalidated.  Surepass will, in certain situations, contact the local Traffic Police for assistance with Breathalyzer tests.

DRIVING STANDARDS AGENCY (DSA)

  1. Training and testing (as arranged with and conducted by the DSA) to be at the time, date and place specified.  All arrangements with the DSA are subject to the terms and conditions of that body over which Surepass has no control.

 ABUSIVE BEHAVIOUR 

  1. Surepass does not tolerate abusive behaviour towards any member of staff, DSA employee or other Surepass student.  Any student behaving in an abusive or disruptive manner will have their training immediately terminated.  They will be asked to leave the premises immediately and any incident may be reported to the police.  No refund will be given for any remaining training. 

GIFT VOUCHERS

  1. Gift Vouchers issued by Surepass are valid for a period of 12 months from the date of issue.  The gift vouchers must be presented with additional documents (see section 3), upon commencement of the course.  Surepass gift vouchers have a monetary value of £0.0001 pence and cannot be exchanged or sold to a third party.  No refunds for purchased gift vouchers will be given at any time.  Surepass gift vouchers are non- transferable.  The purchaser of the gift vouchers is responsible for ensuring the gift voucher recipient has all the necessary documentation (see section 3), required to complete a training course. 

VALUABLES AND PERSONAL PROPERTY

  1. All personal property is left on site at the students own risk.  Valuables and other items can be locked away in the instructors office on request, alternatively items can be left at the booking office across the road which is manned until 17.30 each day.

Surepass reserves the right and at it's discretion to refund the course fee in full instead of providing training and/or testing. 

Surepass reserves the right to vary or change these terms and conditions without prior notice but a copy of current terms and conditions will be provided with response to each booking arrangement being made. 

Surepass reserves the right to vary or change all training course prices without prior notice.

Surepass reserves the right to determine riding standards in all respects as criteria for submitting students for testing.  Such criteria to be in accordance with regulations and guidance as issued by the DSA.

The Chief Instructors word is always final.
